Protected Olympic Marks

Reference to any protected International Olympic Committee or United States Olympic Committee Trademarks, Logos, or Copyrights on the GOLD website, downloadable software, or non-downloadable software fall within permissible usage in the following manner:

1. Historical documentation and description of Personal GOLD helping athletes win Olympic medals at the 2012 London Olympics and referencing their personal property (Olympic medals, Olympic medal-winning).

2. Using the term 'Olympian or Olympic athlete' to describe founders (current or past) or advisors (current or past) that were members of Olympic teams or alternates on Olympic teams. 

Neither of these references constitute or imply endorsement, sponsorship or recommendation thereof of GOLD by the International Olympic Committee, and all references outside the above permissible usage are protected by the International Olympic Committee.

Protected Olympic marks appearing or referenced in the feature documentary film 'Personal Gold, An Underdog Story' fall under 'Fair Use Policy' detailed in the opinion letter by Donaldson Callif, 400 South Beverly Drive, Ste 400, Beverly Hills, CA. 90212.

1. Patents

A patent is a set of exclusive rights granted by a sovereign state or intergovernmental organization to an inventor or assignee for a limited period of time in exchange for detailed public disclosure of an invention. An invention is a solution to a specific technological problem and is a product or a process.

2. Brand Marks

A brand mark is a name, phrase, logo, symbol, or other distinctive identifier used to distinguish a company’s products or services from others in the market. Brand marks help customers recognize the source of a product, build trust, and protect brand identity over time. When a mark is used publicly to identify goods or services, it may be designated with (or for services) to indicate a trademark claim, whether or not the mark is registered.

HERA refers to a Health Enhancing Relational Avatar, namely an interactive, relationship-based digital avatar designed to support and enhance a user’s health, fitness, recovery, performance, and lifestyle outcomes through personalized, context-aware engagement. HERA may present as an embodied or character-based user interface that communicates with a user via text, voice, and/or visual interactions; builds and maintains a personalized coaching relationship over time; and delivers individualized guidance, motivation, education, reminders, and recommendations based on user inputs and/or sensor-derived data. HERA may be configured to map, analyze, and respond to a user’s behaviors, routines, contextual factors, and environment across a continuous 24-hour cycle, and to provide tailored coaching experiences that adapt to the user’s goals, preferences, and changing conditions.

Geolag™ Downloadable and Non-Downloadable Software, and publications for health and fitness advice. 

Geolag refers to the condition in which a user’s sleep–wake cycle and related circadian timing are misaligned with the local Earth light–dark cycle, including local sunrise and sunset times, such that the user’s habitual sleep onset, wake time, and/or light exposure patterns are out of sync with the environmental light cues at the user’s current location. Geolag may be detected, measured, or inferred using user-provided inputs and/or sensor-derived data (including, as applicable, sleep timing, activity, ambient light exposure, location, and time zone) and may be used to generate personalized insights, alerts, recommendations, and coaching intended to improve sleep timing alignment, sleep quality, recovery, health, fitness, and performance outcomes.

3. Copyrights

Copyright is a legal right created by the law of a country that grants the creator of an original work exclusive rights for its use and distribution. This is usually only for a limited time. The exclusive rights are not absolute but limited by limitations and exceptions to copyright law, including fair use.

4. Other Third Party Marks

All third party trademarks referenced by GOLD website and software whether in logo form, name form or product form, or otherwise remain the property of their respective holders, and are used by us only to refer to the contextual use of the development of software and other technology and products utilizing health and fitness advice and supporting third party solutions. Our use of these trademarks in no way indicates any relationship between GOLD and the holders of these trademarks. Rather, any usage of third party trademarks by us is to refer to such products is considered nominative fair use under trademark law.
